A liability waiver does two jobs at once. It documents that the participant understood the specific risks of your activity, and it releases your business from claims arising out of ordinary negligence. Courts routinely enforce waivers that do both clearly — and routinely throw out waivers that bury the release in fine print or never describe the actual risks.
That is why this template lists risks in plain language instead of a single catch-all sentence. A waiver that says "participant assumes all risks" is far weaker than one that names the specific hazards a participant could reasonably encounter at your business.
Enforceability varies by state. A handful of states are hostile to pre-injury releases, most enforce them for ordinary negligence, and none enforce a release of gross negligence or intentional harm. Use this as a starting draft and have your attorney or insurer confirm the wording for where you operate.
